PUBLIC CONTRACT (OFFER)
\nfor ordering, purchase, and delivery of goods<\/p>\n

This contract is an official and public offer from the Seller to conclude a contract for the purchase and sale of Goods presented on the website https:\/\/kord-spectkan.com.ua<\/a>. This contract is public, meaning that according to Article 633 of the Civil Code of Ukraine, its terms are the same for all buyers, regardless of their status (individual, legal entity, individual entrepreneur) without giving preference to one buyer over another. By concluding this Agreement, the buyer fully accepts the terms and conditions of placing an order, paying for the goods, delivering the goods, returning the goods, and liability for dishonest orders, as well as all other terms of the contract. The Agreement is considered concluded from the moment the “Confirm Order” button is clicked on the order page in the “Cart” section and the Buyer receives an electronic confirmation of the order from the Seller.<\/p>\n

  1. Definitions of Terms<\/li>\n<\/ol>\n

    1.1. Public offer (hereinafter referred to as the “Offer”) \u2013 a public proposal from the Seller, addressed to an indefinite circle of persons, to conclude a contract for the purchase and sale of goods with the Seller remotely (hereinafter referred to as the “Contract”) under the terms contained in this Offer.<\/p>\n

    1.2. Goods or Services \u2013 the object of the agreement between the parties, which was selected by the buyer on the website of the online store and placed in the cart, or already purchased by the Buyer from the Seller remotely.<\/p>\n

    1.3. Online Store \u2013 the Seller’s website at https:\/\/kord-spectkan.com.ua<\/a>, created for the purpose of concluding retail and wholesale purchase and sale contracts based on the Buyer\u2019s acquaintance with the description of the Goods offered by the Seller through the Internet.<\/p>\n

    1.4. Buyer \u2013 a capable individual who has reached the age of 18, receives information from the Seller, places an order to purchase goods presented on the website of the online store for purposes not related to entrepreneurial activities, or a legal entity or individual entrepreneur.<\/p>\n

    1.5. Seller \u2013 FOP “Fedosenko Oleksandr Olegovich” (identification code 3617203394), an individual entrepreneur established and operating in accordance with the current legislation of Ukraine, located at: Konstiantynivka, Keramichna Street, Building 31.<\/p>\n

    1. Subject of the Agreement<\/li>\n<\/ol>\n

      2.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.<\/p>\n

      2.2. The date of conclusion of the Offer Agreement (acceptance of the offer) and the moment of full and unconditional acceptance by the Buyer of the terms of the Agreement is the date the Buyer completes the order form on the website of the online store, provided the Buyer receives an electronic confirmation of the order from the Seller. If necessary, at the request of the Buyer, the Agreement may be executed in writing.<\/p>\n

      1. Placing an Order<\/li>\n<\/ol>\n

        3.1. The Buyer independently places an order in the online store through the “Cart” form, or by placing an order via email or by phone number provided in the contact section of the online store.<\/p>\n

        3.2. The Seller has the right to refuse to transfer the order to the Buyer if the information provided by the Buyer when placing the order is incomplete or raises suspicions about its validity.<\/p>\n

        3.3. When placing an order on the website of the online store, the Buyer is required to provide the following mandatory information necessary for the Seller to fulfill the order:<\/p>\n

        3.3.1. Buyer\u2019s surname, first name; 3.3.2. Address for delivery of the Goods (if delivery to the Buyer’s address is required); 3.3.3. Contact phone number. 3.3.4. Identification code for a legal entity or individual entrepreneur.<\/p>\n

        3.4. The name, quantity, article, price of the Goods selected by the Buyer are indicated in the Buyer’s cart on the website of the online store.<\/p>\n

        3.5. If any of the Parties to the contract requires additional information, they have the right to request it from the other Party. In the event that the Buyer does not provide the necessary information, the Seller is not responsible for providing quality service to the Buyer when purchasing goods in the online store.<\/p>\n

        3.6. When placing an order through the Seller\u2019s operator (p. 3.1. of this Offer), the Buyer is required to provide the information specified in p. 3.3 \u2013 3.4. of this Offer.<\/p>\n

        3.7. The Buyer’s acceptance of the terms of this Offer is carried out by entering the Buyer\u2019s data in the registration form on the website of the online store or when placing an Order through the operator. After placing an Order through the Operator, the Buyer’s data is entered into the Seller’s database.<\/p>\n

        3.8. The Buyer is responsible for the accuracy of the information provided when placing the Order.<\/p>\n

        3.9. By concluding the Agreement, i.e., accepting the terms of this offer (the proposed terms of purchase of the Goods) by placing an Order, the Buyer confirms the following: a) The Buyer is fully and completely acquainted with and agrees to the terms of this offer; b) They consent to the collection, processing, and transfer of personal data, the consent to the processing of personal data is valid throughout the duration of the Agreement, as well as for an unlimited period after its termination. Moreover, by concluding the agreement, the Buyer confirms that they have been informed (without additional notification) of the rights established by the Law of Ukraine “On the Protection of Personal Data,” the purposes of data collection, as well as the fact that their personal data is transferred to the Seller to enable the fulfillment of the terms of this Agreement, the ability to conduct mutual settlements, as well as to receive invoices, acts, and other documents. The Buyer also agrees that the Seller has the right to provide access to and transfer their personal data to third parties without any additional notifications to the Buyer for the purpose of fulfilling the Buyer\u2019s order. The scope of the Buyer’s rights as a subject of personal data according to the Law of Ukraine “On the Protection of Personal Data” is known and understood.<\/p>\n","protected":false},"excerpt":{"rendered":"
